Should you choose to pay for your purchase in installments, you agree to the terms listed herein. The eZ-Pay Plan Agreement (the “Agreement”) includes the “eZ-Pay Schedule” that is provided to you and contained in your customer portal at www.silencercentral.com/login and by email after you complete a purchase and opt-in to participate in an eZ-Pay Plan.

Use of the words “you” and “your” throughout this Agreement shall refer to the customer listed, and the words “we,” “us,” and “our” shall refer to BMaddox Enterprises LLC d/b/a Silencer Central or its assignees.

Promise to Pay

The Agreement governs your payment to us to acquire goods or services that you have selected. You promise to pay the sum of your first installment (“Down Payment”) and other installments under this Agreement on the dates and according to the installment amounts displayed on your “eZ-Pay Schedule” (inclusive of all taxes and fees) until the goods or services have been paid in full. You understand that the actual installment amounts and due dates of your Down Payment and the installments in your eZ-Pay Schedule will be provided to you electronically.

There Are No Finance Charges and No Interest Payments Associated with This Agreement

The issuer of your Payment Method (defined below) may charge you interest or other charges in accordance with the terms and conditions of the agreement between you and your Payment Method issuer.

Installment Payments

When you accept this Agreement and complete a purchase, you will identify your preferred method of payment, designating a credit or debit card as your “Payment Method.” In addition to any required Down Payment, you must make either three (3), six (6), or eight (8) monthly installment payments to us as agreed upon at the time of purchase (each, an “Installment Payment”) in the amounts shown under your eZ-Pay Schedule. You are responsible for ensuring you have sufficient funds available to make Installment Payments on the dates specified in your eZ-Pay Schedule.

Early Payments

You may pay your balance in full at any time before a scheduled Installment Payment without penalty. Early or overpayment of one or more scheduled Installment Payments will adjust the amounts due on your remaining eZ-Pay Schedule.

Payment Plan Adjustments

Any requests to adjust a Payment Installment due date or the amount of an Installment Payment, or to extend the duration of your eZ-Pay Schedule, are approved or denied at the sole discretion of Silencer Central. Requests for Installment Payment adjustments must be made at least two (2) full business days prior to the due date of a scheduled Installment Payment. Payment plans cannot be combined.

Delinquency and Default

If your Payment Method fails and an Installment Payment is not submitted for four (4) consecutive weeks, Silencer Central reserves the right, in Silencer Central’s sole discretion, to cancel the order and withdraw your application to ATF. In this event, you will receive a refund for the Installment Payments paid as of the cancellation date in the form of a Silencer Central e-gift card, less a twenty-five percent (25%) or $200 processing fee (whichever is greater).

Order Cancellation and Refunds

Order cancellations and refunds are subject to our Cancellation/Return/Refund Policies. If, for any reason, you change your mind after purchasing and wish to cancel your order, you will receive a refund for the amount paid at the time of cancellation, less a twenty-five percent (25%) or $200 processing fee (whichever is greater) issued in the form of a Silencer Central e-gift card. Cancellation must be within thirty (30) days of purchase and before any ATF paperwork has been submitted for the item. Unfortunately, once application forms have been submitted to ATF, we are unable to cancel your order.

Governing Law

The laws of the State of South Dakota will govern the interpretation and enforcement of this Agreement.
